How Does Foreclosure Work?
Hutchens Law Firm, P.A., has experience with all foreclosure processes, and currently handles most foreclosures through a judicial process, where the lender brings an action in the clerk or circuit court. Upon approval of a foreclosure for any parcel being foreclosed upon, a judgment is obtained and an Order of Sale is issued. If no objections are made to the sale, and the Order of Sale is confirmed by the Court, the property and all interests, rights and claims against the property are sold subject to all liens, easements, restrictions and right-of-way encumbrances. The sale proceeds are applied to pay costs that are accrued, with any surplus being distributed to junior lienholders and to the appropriate parties depending on the type of foreclosure proceeding.
In the past, many foreclosures were also done by power of sale where the deed provided the lender with the right to foreclose without court action. With this type of foreclosure, if no one contests the foreclosure, the deed, which is re-conveyed to the lender, is recorded and takes effect when it is recorded. Many deeds also provide for a notice of sale to be published in the local paper for up to four consecutive weeks prior to the sale.

L. v. M. In the end, we got Mrs. L a modification and she was able to resolve her housing issues. Mrs. L was behind on her mortgage payments and lenders were trying to foreclose on her property. Due to Ms. L’s poor medical condition, she required assistance in researching the foreclosure process to discuss her options. Her health had been failing for some time and she fell behind on her bills, including her mortgage. Mrs. L’s loan was with two lenders. Both lenders initiated foreclosure proceedings. Ms. L sought the help of a HUD approved Housing Counseling Agency, but they were unfamiliar with North Carolina’s laws and referred her to our firm. Mrs. L’s health was declining and she had difficulty understanding what was happening with her home. She was unable to afford the higher mortgage payment, but could afford a lower payment in a modified loan. The attorneys at Hutchens Law Firm helped her negotiate with her lenders. After more than a year of negotiations, we were eventually able to get her a modification with one of the lenders. This loan modification reduced Mrs. L’s payments from $1,650.00 to $1,163.00 and she was able to remove the second lender, who was collecting the higher interest payment. By eliminating the second loan, Mrs. L saved a total of $15,735 over the life of the loans. Without help from the firm, Mrs. L would have lost her home to foreclosure and she would still owe the money she could not afford when she obtained her second loan.
